These Terms & Conditions ("Terms") govern your access to and use of the services provided by HB Funded, a company registered in England & Wales, trading as HB Funded ("HB Funded", "we", "us", or "our"), via our website hbfunded.co.uk (the "Website").

Please read these Terms carefully before purchasing or using any of our services. By accessing the Website, purchasing an evaluation, or using any part of our platform, you confirm that you have read, understood, and agree to be bound by these Terms.

1. Acceptance of Terms

By registering for an account, purchasing an evaluation package, or otherwise using the services offered by HB Funded, you agree to these Terms in full. If you do not agree with any part of these Terms, you must not use our services.

These Terms constitute a legally binding agreement between you ("the Trader", "you", or "your") and HB Funded. Your continued use of the Website or services following any update to these Terms will constitute your acceptance of the revised Terms.

2. Nature of Our Services

HB Funded provides a trader evaluation service. This service is designed to identify skilled traders through a structured, simulated assessment process. We do not offer regulated financial products, investment advice, portfolio management, or any service regulated by the Financial Conduct Authority (FCA).

You should not treat any content on this Website, or any interaction with HB Funded staff, as constituting financial advice. If you require regulated financial advice, you should consult an FCA-authorised firm.

2.1 Evaluation Service

When you purchase an evaluation, you gain access to a simulated trading environment using virtual capital. The evaluation is conducted via a demo or simulation account on the trader's chosen trading platform, which may include spread betting, CFD, forex, or cryptocurrency brokers. All trading activity undertaken during the evaluation phase is entirely simulated; no real money is placed in financial markets on your behalf.

2.2 Approved Trading Platforms

Traders must conduct their evaluation using a demo account on one of the following HB Funded-approved platforms. Use of any platform not listed below is not permitted and may result in your evaluation being voided without refund:

• Admirals (Admiral Markets) — Forex / CFDs (MT4 / MT5)
• Tickmill — Forex / CFDs (MT4 / MT5)
• FxPro — Forex / CFDs (MT4 / MT5)
• ThinkMarkets — Forex / CFDs (MT4 / MT5)
• Binance — Cryptocurrency (testnet / demo)
• Bybit — Cryptocurrency (demo account)

HB Funded reserves the right to add or remove approved platforms at any time. Traders will be notified of any changes via email or the platform dashboard. If your preferred platform is not listed, please contact us at support@hbfunded.co.uk to request consideration.

2.3 Virtual Funded Accounts

Upon successfully passing the evaluation, you may be granted access to a virtual funded account. This account is funded with notional (virtual) capital. Profit share payments made to successful traders are paid by HB Funded from our own funds based on your simulated trading performance — they do not represent returns from live market participation on your behalf.

At no point do you trade real money or receive investment management services. The virtual funded account is not a brokerage account, and HB Funded is not acting as your broker, financial adviser, or investment manager.

3. Eligibility

To use our services, you must:

• Be at least 18 years of age;
• Have the legal capacity to enter into a binding contract under the laws of your jurisdiction;
• Not be a resident of, or located in, any Restricted Jurisdiction (defined below); and
• Not be accessing our services in violation of any applicable local, national, or international law or regulation.

Our services are primarily intended for residents of the United Kingdom. We welcome international participants where permitted by local law, but it is your sole responsibility to ensure that your use of our services is lawful in your country of residence.

3.1 Restricted Jurisdictions

We do not offer services to residents or citizens of countries subject to comprehensive sanctions by the United Kingdom, European Union, or United Nations, including but not limited to: North Korea, Iran, Russia, Belarus, Cuba, Syria, and any other jurisdiction designated as high-risk or subject to financial sanctions at the time of registration. This list may be updated from time to time in line with applicable sanctions law. By registering, you confirm that you are not a resident or citizen of any such jurisdiction.

3.2 One Account Per Person

Each individual is permitted to hold one active account with HB Funded at any time, unless expressly agreed otherwise in writing. Operating multiple accounts without permission is a breach of these Terms and may result in immediate termination of all accounts.

4. Evaluation Rules

By purchasing an evaluation, you agree to trade strictly in accordance with the evaluation rules as set out on our Rules page at hbfunded.co.uk (the "Rules"), which are incorporated into these Terms by reference.

The key parameters governing each evaluation include, but are not limited to:

• Profit Target: You must reach a specified profit target as set out for your chosen evaluation tier.
• Maximum Drawdown: You must not exceed the maximum drawdown limit applicable to your account at any time.
• No Time Limit: There is no minimum or maximum time limit imposed on completing the evaluation, unless otherwise stated for a specific evaluation type.
• Trading Rules: All additional rules, restrictions, and requirements set out on the Rules page must be observed at all times.

HB Funded reserves the right to update evaluation parameters and rules at any time. Any changes will be communicated on the Website and will not apply retrospectively to evaluations already purchased and in progress, except where required by law.

4.1 Rule Violations

If you breach any evaluation rule, your evaluation will be considered failed and your account may be terminated. In such cases, the evaluation fee is non-refundable subject to the exceptions set out in Section 5 below.

5. Fees and Refund Policy

5.1 Evaluation Fee

To participate in an evaluation, you must pay the applicable evaluation fee as displayed on the Website at the time of purchase. All fees are quoted in Pounds Sterling (GBP) inclusive of any applicable taxes. Payment must be made in full before access to the evaluation is granted.

5.2 Non-Refundable Fees

All evaluation fees are non-refundable, except as expressly provided in Section 5.3 below. By purchasing an evaluation, you acknowledge that you are paying for access to the evaluation service and not for a guaranteed outcome.

5.3 First Payout Refund

As an exception to Section 5.2, if you successfully pass the evaluation and receive your first profit share payout from your virtual funded account, HB Funded will refund your evaluation fee in full as part of that first payout. This refund will be applied automatically and does not need to be separately requested. This refund is available once per trader and applies to the first evaluation only.

5.4 Refund Request Process

To request a refund review, email support@hbfunded.co.uk with your account reference number and the reason for your request. Refund requests are reviewed within 5 business days. If your evaluation was voided due to a platform error or technical fault on our part, a full refund will be issued within 10 business days.

5.5 No Chargebacks

Initiating a chargeback or payment dispute without first contacting HB Funded to resolve the matter in good faith is a breach of these Terms. We reserve the right to terminate your account and take appropriate action to recover any amounts owed in such circumstances.

6. Virtual Funded Accounts and Profit Share

6.1 Granting of Funded Account

Upon successfully meeting all evaluation objectives and satisfying any additional verification requirements, you will be offered access to a virtual funded account. Acceptance of the funded account is subject to your continued compliance with these Terms.

6.2 Profit Share Splits

Profit share is calculated on net profits generated in your virtual funded account during a payout period. The profit share percentage applicable to your account is determined by your time as a funded trader, and applies equally regardless of which evaluation plan you purchased, as follows:

Your applicable tier is based on your continuous time as a funded trader and is shown in your account dashboard, regardless of which evaluation plan you purchased. HB Funded retains the remainder of net profits. Profit share splits may be subject to change for new accounts with reasonable prior notice.

6.3 Payout Process

You may request a profit share payout at any time, subject to meeting the minimum payout conditions specified in your account dashboard. HB Funded will process approved payout requests within 2-3 business days of the payout being confirmed. Payout timelines may be affected by public holidays, banking delays, or verification requirements outside our reasonable control.

6.4 Virtual Nature of Funded Accounts

The capital displayed in your virtual funded account is notional and does not represent real funds held on your behalf. Profit share payments are made by HB Funded from its own resources as a contractual obligation, not as a return on investment or a regulated financial product.

7. Referral Programme

HB Funded operates a referral programme that allows existing account holders to earn rewards by referring new traders to the platform. Participation in the referral programme is subject to the following terms:

7.1 Referral Rewards

• Evaluation Fee Reward: You will earn £25 for each eligible referred trader who registers using your unique referral link and completes payment of their evaluation fee. This reward is paid within 5 business days of the fee payment being confirmed, subject to anti-fraud checks. The £25 reward applies to the referred trader's first evaluation purchase only.
• Maximum Reward Per Referral: The maximum reward per individual referred trader is £25. No further reward is paid if the same referred trader re-purchases an evaluation.
• Lifetime Earnings Cap: Your total lifetime referral earnings are capped at £1,000. Once this cap is reached, no further referral rewards will be credited to your account.

7.2 Eligibility Conditions

• Referral rewards apply to first-time registrations only. A referred trader must not have previously held an account with HB Funded.
• Referral rewards apply to the referred trader's first evaluation purchase only.
• Self-referrals are strictly prohibited. You may not refer yourself, members of your household, or individuals acting in concert with you to earn referral rewards.
• The referred trader must register and complete a purchase using your referral link; referrals submitted after the fact will not be honoured.

7.3 Anti-Fraud

Any attempt to manipulate, exploit, or abuse the referral programme — including but not limited to creating fictitious accounts, using multiple identities, coordinating bulk referrals in bad faith, or engaging in any deceptive practice — will result in the immediate cancellation of all pending and accrued referral rewards, termination of your account, and may be reported to relevant authorities. HB Funded reserves the right to withhold, reverse, or reclaim referral rewards where fraudulent activity is suspected or confirmed.

7.4 Changes to the Referral Programme

HB Funded reserves the right to amend, suspend, or terminate the referral programme at any time with reasonable notice. Changes will not affect rewards already validly earned and confirmed prior to the effective date of any change.

8. Prohibited Conduct

You must use our services honestly, fairly, and in accordance with these Terms. The following conduct is strictly prohibited and constitutes a material breach of these Terms:

• Cheating and Manipulation: Any attempt to manipulate, exploit, or game the evaluation system, including exploiting latency, data feed errors, or platform vulnerabilities, is prohibited.
• Collusion: Coordinating trades across multiple accounts — whether your own or with other traders — to artificially achieve evaluation objectives or profit targets is prohibited. This includes hedging strategies designed to pass the evaluation through coordinated opposing positions across different accounts.
• Reverse Engineering: Attempting to reverse engineer, decompile, disassemble, or otherwise derive the source code, algorithms, or proprietary systems of HB Funded's platform is prohibited.
• Automated Trading (Bots / Expert Advisors): The use of fully automated trading bots, Expert Advisors (EAs), or any algorithmic trading system that operates without meaningful human oversight and decision-making is prohibited, unless HB Funded has given express prior written consent for a specific tool or strategy.
• Multiple Accounts: Operating more than one account without HB Funded's prior written consent is prohibited.
• Misrepresentation: Providing false, misleading, or incomplete information during registration or at any other point is prohibited.
• Unlawful Use: Using the Website or services for any unlawful purpose, or in a manner that infringes the rights of any third party, is prohibited.

HB Funded reserves the right to investigate suspected breaches and to take any action it deems appropriate, including immediate account termination and forfeiture of accrued rewards or profit share.

9. Intellectual Property

All content on the Website, including but not limited to text, graphics, logos, software, platform interfaces, evaluation materials, trading dashboards, and documentation (collectively, "Content"), is the exclusive intellectual property of HB Funded or its licensors and is protected by United Kingdom and international copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Website and our services for your own personal, non-commercial use in accordance with these Terms. This licence does not permit you to:

• Copy, reproduce, republish, or distribute any Content without our prior written consent;
• Create derivative works based on the Content;
• Use the HB Funded name, logo, or trademarks without prior written authorisation; or
• Use the Content for any commercial purpose not expressly authorised by us.

Any feedback, suggestions, or ideas you provide to HB Funded regarding our services may be used by us freely without restriction or compensation to you.

10. Limitation of Liability

10.1 Virtual Accounts — No Real Trading Losses

Because all trading activity on the HB Funded platform takes place in a simulated environment using virtual capital, you cannot incur real trading losses through use of our platform. HB Funded accepts no liability whatsoever for any simulated losses displayed in your evaluation or virtual funded account.

10.2 General Limitation

To the maximum extent permitted by applicable law, HB Funded, its directors, employees, agents, and licensors shall not be liable to you for:

• Any indirect, incidental, special, consequential, or punitive loss or damage;
• Loss of profits, revenue, opportunity, data, or goodwill;
• Any loss arising from your reliance on information provided on the Website;
• Any interruption, suspension, or termination of the platform or services; or
• Any loss or damage caused by events outside our reasonable control (force majeure).

10.3 Cap on Liability

Where HB Funded is found to be liable to you for any claim arising from or connected to these Terms or our services, our total aggregate liability shall not exceed the total evaluation fees paid by you to HB Funded in the twelve (12) months immediately preceding the event giving rise to the claim.

10.4 Statutory Rights

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or restricted under the laws of England and Wales, including rights afforded to consumers under the Consumer Rights Act 2015.

11. Termination

11.1 Termination by HB Funded

HB Funded reserves the right to suspend or terminate your account, evaluation access, or virtual funded account at any time, with or without notice, in the following circumstances:

• You have breached any provision of these Terms or the Rules;
• We reasonably suspect fraudulent, deceptive, or abusive activity;
• You have provided false or misleading information;
• Continued operation of your account would expose HB Funded to legal, regulatory, or reputational risk; or
• We are required to do so by law or a competent authority.

Where your account is terminated for breach of these Terms, any accrued but unpaid profit share, referral rewards, or evaluation fee refunds shall be forfeited.

11.2 Termination by You

You may close your account at any time by contacting us at support@hbfunded.co.uk. Closing your account does not entitle you to a refund of any evaluation fees, except as expressly provided in Section 5.3.

11.3 Effect of Termination

Upon termination for any reason, your right to access the platform and all associated services will cease immediately. Provisions of these Terms that by their nature should survive termination — including but not limited to Sections 8, 9, 10, 12, and 13 — shall continue to apply.

12. Governing Law and Disputes

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

In the event of any dispute, we encourage you to contact us in the first instance at support@hbfunded.co.uk so that we may attempt to resolve the matter informally. If the matter cannot be resolved informally, both parties agree to submit to the exclusive jurisdiction of the courts of England and Wales.

13. Complaints Procedure

13.1 How to Make a Complaint

HB Funded is committed to providing a fair and transparent service. If you are dissatisfied with any aspect of our services, you have the right to make a formal complaint. Please contact us in the first instance by email at support@hbfunded.co.uk with the subject line "Formal Complaint". Please include:

• Your full name and registered email address
• A clear description of your complaint and the outcome you are seeking
• Any relevant dates, transaction references, or supporting evidence

13.2 Acknowledgement and Response

We will acknowledge receipt of your complaint within 5 business days. We aim to provide a full written response within 28 days of receiving your complaint. Where the matter is complex and requires additional time, we will notify you of the delay and provide a revised timeline.

13.3 Escalation

If you are not satisfied with our response, or if we have not provided a final response within 8 weeks, you may escalate your complaint to an independent third party. As HB Funded is not regulated by the Financial Conduct Authority (FCA), access to the Financial Ombudsman Service (FOS) is not available. However, you may seek resolution through the courts of England and Wales in accordance with Section 14 of these Terms.

13.4 Record Keeping

We keep a record of all complaints received and our responses for a minimum of 5 years. This helps us identify and improve any systemic issues with our service.

14. Changes to These Terms

HB Funded reserves the right to amend these Terms at any time. We will notify you of material changes by posting an updated version on the Website and updating the "Last updated" date at the top of this page. Where a change is material, we will endeavour to provide at least 14 days' notice before the change takes effect, either by email or by prominent notice on the Website.

Your continued use of the Website or services after the effective date of any amended Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must cease using our services and contact us to close your account.

15. Data Protection and Privacy

HB Funded processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. By using our services, you acknowledge that we collect and process your personal data as described in our Privacy Policy, available on the Website. We will only use your personal data for the purposes set out in our Privacy Policy and will not sell your data to third parties.

16. General

16.1 Entire Agreement

These Terms, together with the Rules, Privacy Policy, and any other documents expressly incorporated by reference, constitute the entire agreement between you and HB Funded in relation to the services and supersede all prior agreements, representations, or understandings.

16.2 Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from the remaining Terms, which shall continue in full force and effect.

16.3 Waiver

No failure or delay by HB Funded in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy.

16.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. HB Funded may assign these Terms or any rights under them to a successor entity in the event of a merger, acquisition, or sale of all or substantially all of our assets.
